Non-Confidential Employee Reporting Obligations

At Nazareth, with the exception of those employees designated at Confidential Resources, all University employees, including staff, faculty, administrators, and students who are Resident Assistants, are required to notify the Civil Rights Compliance office directly when they receive information about conduct that reasonably may constitute as prohibited conduct in the Title IX, and Sexual Misconduct policies. The report must include all known information regarding an incident, including the names and identities of involved parties.

A disclosure may be direct or indirect, may have occurred on or off campus; during the academic year or over breaks; and may be an experience prior to enrollment at the University or while an active student.

Handling a disclosure

In accordance with New York State Education Law 129-B, if someone tells you they have experienced sexual misconduct, notify the individual of the following:

You have the right to make a report to University Campus Safety, local law enforcement, and/or state police, or choose not to report;
You have the right to report the incident to the University, to be protected by the University from retaliation for reporting an incident; and
You have the right to receive assistance and resources from the University’s Title IX Coordinator.

Follow the steps below in order to affirm an individual’s safety and to provide overall support:

  1. Confirm that the person is physically safe. Contact Campus Safety if there is an immediate threat to the person’s wellbeing.
  2. Explain your obligation to refer them to the Title IX Coordinator and share details of the incident to the office. Let them know that the Civil Rights Compliance Office will keep their information private, and will only share it with those who need to know in order to provide further resources.
  3. Provide non-judgement support which includes active listening, using terminology used by the reporter and not making assumptions, and not placing blame on the individual sharing their experience.
  4. Let the individual know that they should hear from someone in the Civil Rights Compliance Office
